This reflection item provides an edited account of human rights lawyer Harriet Wistrich’s conversation with Manvir Grewal, Visiting Lecturer and Ph.D. student, and Harriet Samuels, Reader in Law at the University of Westminster. It summarises the exchange which focused on Harriet Wistrich’s career trajectory and the many public interest law cases that she has brought on behalf her clients, mainly women, in both domestic and international forums. It also includes a condensed version of the question and answer (...) session with the audience. This paper presents four arguments in favour of respecting Ulysses Contracts in the case of individuals who suffer with severe chronic episodic mental illnesses, and who have experienced spiralling and relapse before. First, competence comes in degrees. As such, even if a person meets the usual standard for competence at the point when they wish to refuse treatment (time 2), they may still belesscompetent than they were when they signed the Ulysses Contract (time 1). As such, even if competent at (...) time 1andtime 2, there can still be a disparity between thelevelsof competence at each time. Second, Ulysses Contracts are important to protect people’smost meaningfulconcerns. Third, on the approach defended, the restrictions to people’s liberty would be temporary, and would be consistent with soft paternalism, rather than hard paternalism: the contracts would be designed in such a way that individuals would be free to change their minds, and to change or cancel their Ulysses Contracts later. Finally, even if one rejects the equivalence thesis (the claim that allowing harm is as bad as doing harm), this is still consistent with the claim that, inparticular cases, it can be as wrong toallowa harm as to do a harm. Nevertheless, controversies remain. This paper also highlights several safeguards to minimise risks. Ultimately, we argue that people who are vulnerable to spiralling deserve a way to protect their autonomy as far as possible, using Ulysses Contracts when necessary. (shrink)

According to the Argument for Autonomous Mental Disorder, mental disorder can occur in the absence of brain disorder, just as software problems can occur in the absence of hardware problems in a computer. This article argues that the AAMD is unsound. I begin by introducing the “natural dysfunction analysis” of disorder, before outlining the AAMD. I then analyze the necessary conditions for realizer autonomous dysfunction. Building on this, I show that software functions disassociate from hardware functions in a way that (...) mental functions do not disassociate from brain functions. The Enlightenment is commonly held accountable for the rise of both racial classification and modern scientific racism. Yet this argument sits uneasily alongside the birth of a modern rights language and strong anticolonial perspectives within the same intellectual movement. This article seeks to make sense of this paradox by arguing that one of the contexts in which we can best understand eighteenth-century race concepts is humanity’s place in a transformed history of nature that brought together novel understandings of deep time (...) and a materialist view of reproduction. Analysing the thought of Georges-Louis Leclerc, Comte de Buffon and Denis Diderot, the article demonstrates that the waning of both the authority of biblical genealogies and ancient environmentalist explanations of human physical diversity left a lacuna in the eighteenth-century human sciences. Buffon and Diderot’s “races” of humanity are not fixed entities, but rather exist in the flux of time. New understandings of heredity and reproduction combined with a time revolution led these Enlightenment thinkers to reconceive humanity’s place in the natural world. The article suggests that while “race” is a biologically incoherent concept, two elements of these Enlightenment thinkers’ anthropology – a materialist understanding of reproduction and humanity’s place in deep time – remain central to how we understand human diversity. In Go Set a Watchman, Harper Lee reveals that American man of integrity Atticus Finch harbors deep-seated racist beliefs. Bob Ewell, Finch's nemesis in To Kill a Mockingbird, harbors the same beliefs. But the two men live out their shared racist beliefs in dramatically different fashions. This article argues that extant dispositionalist accounts of belief lack the tools to accommodate Finch and Ewell's divergent styles of believing. It then draws on literary and philosophical character studies to construct the required tools.

The triumph was the most prestigious accolade a politician and general could receive in republican Rome. After a brief review of the role played by the triumph in republican political culture, this article analyzes the severe limits Augustus placed on triumphal parades after 19 BC, which then became very rare celebrations. It is argued that Augustus aimed at and almost succeeded in eliminating traditional triumphal celebrations completely during his lifetime, by using a combination of refusing them for himself and his (...) relatives and of rewarding his legates who fought under his auspices with ornamenta triumphalia and an honorific statue in the Forum of Augustus. Subsequently, the elimination of the triumph would have been one natural result of the limit placed on further imperial expansion recommended by Augustus in his will, a policy his successors chose not to follow. Tiberius, however, was unwilling to conform to this new order and retired from public life to Rhodes the year after celebrating a triumph in 7 BC, the first such celebration since 19 BC. Tiberius' two triumphs and the senate's repeated offers of further triumphs to Augustus himself represented a different vision of the role triumphal celebration should take in a restored res publica and an ongoing challenge to the princeps. Defining Mental Disorder: Jerome Wakefield and His Critics, edited by Denis Forest and Luc Faucher, is essential reading for students and researchers in philosophy of medicine whose work is informed by that of Jerome Wakefield, or the disease debate in general. If you are anything like me, this book will open the door to a new depth of understanding of the harmful dysfunction analysis (HDA) and its methodical underpinnings, and an enriched appreciation of what is at stake in defining medical (...) disorder. To those confident that they understand Wakefield’s view and the surrounding debate, thinking perhaps that they do not need a refresher, I would say: perhaps you do not understand it as well as you think. Defining Mental Disorder provides much more than an overview of previously well-trodden ground. The chapters themselves, and Wakefield’s own detailed responses, help to elucidate a number of methodological nuances and peculiarities that have rarely been covered in such depth before. I was startled to learn how philosophically complex Wakefield’s position actually is, and how shallow my own understanding of it has been. It emerges as a far more nuanced and sophisticated account than I had given it credit for, and one that deserves serious reevaluation. (shrink)

This book examines an important area of Aristotle's philosophy: the generation of substances. While other changes presuppose the existence of a substance (Socrates grows taller), substantial generation results in something genuinely new that did not exist before (Socrates himself). The central argument of this book is that Aristotle defends a 'hylomorphic' model of substantial generation. In its most complete formulation, this model says that substantial generation involves three principles: (1) matter, which is the subject from which the change proceeds; (2) (...) form, which is the end towards which the process advances; and (3) an efficient cause, which directs the process towards that form. By examining the development of this model across Aristotle's works, Devin Henry seeks to deepen our grasp on how the doctrine of hylomorphism - understood as a blueprint for thinking about the world - informs our understanding of the process by which new substances come into being. This bibliography seeks to offer a comprehensive overview of nuclear criticism, tracing its development from the 1984 issue of diacritics which saw the publication of Derrida's seminal article “No Apocalypse, Not Now ” to the present day. Particular attention is paid to areas of interest which are underrepresented in the available literature, and every attempt has been made to offer a resource which is wide-ranging in outlook while providing a clear sense of the central texts which have shaped and reshaped (...) what we understand as nuclear criticism. Texts focusing solely on individual works have, by and large, been excluded. Brief notes accompany some of the entries, although it has not been practical to provide these for all the works mentioned: they should be taken as a record of an individual approach to the texts in question rather than as marks of overarching significance. Although algorithmic information theory provides a measure of the information content of string of characters, problems of noise and noncomputability emerge. However, if pattern in a noisy string is recognized by reference to a set of similar strings, this article shows that a compressed algorithmic description of a noisy string is possible and illustrates this with some simple examples. The article also shows that algorithmic information theory can quantify the information in complex organized systems where pattern is nested within pattern.

Philip Kitcher's arguments for realism and secular humanism reveal a question as to the role of transcendence in pragmatism. There is a tension between Deweyan anti-foundationalism and naturalism—between the continuity of experience and nature, and the external reality of the universe— which re-emerges in Kitcher's “real realism.” The transcendence of the natural and the transcendence of the supernatural are distinct as regards their accessibility to inquiry. But the pragmatic fallibilist resistance to sources of justification external to the process of inquiry, (...) or “sky-hooks,” also clashes with the transcendence of nature insofar as it is viewed as a foundation. I argue that transcendence can be conceived not as a substance or ground, but as a possibility of radical receptivity or renewal, and that this is compatible with the continuity of inquiry. If this shift is made, religious transcendence can appear less as a flight to another world and more a method of producing a break with the (sinful).. (shrink)

In this essay, I attempt to show that the “war on terror” intensifies the use of biopolitical techniques. One such example, which I take as a point of departure, is Guantánamo Bay. We must place this camp in its proper genealogy with the many camps of the twentieth century. However, this genealogy is not a genealogy of the extremes of political space during and after the twentieth century; it is a genealogy of the transformation of political space itself. I will (...) attempt to show this in three steps: first, a description and critique of the biopolitical in both Michel Foucault and Giorgio Agamben, who I take as exemplary in their analyses; second, an analysis of contemporary biopolitical techniques (including the camp), which enables us to avoid the liberal-democratic ideological misunderstanding of the war on terror; and third, a discussion regarding resistance to biopolitical techniques. In the last two decades, prizes in the sciences have proliferated and, in particular, rich prizes with large honoraria. These developments raise several questions: Why have rich prizes proliferated? Have they greatly changed the reward system of science? What effects will such prizes have on scientists and on science? The proliferation of such prizes derives from marked limitations on the numbers and types of scientists eligible for Nobel prizes and consequent increases in the number of uncrowned laureate-equivalents. These would-be surrogates (...) for Nobel prizes extend the reward system of science in its upper reaches but this change is not fundamental. The spread of rich prizes to new fields provides added incentives to potential winners, which has its own disutilities; it reinforces competitiveness, concern for priority and attendant secrecy, all this amplifying ambivalence toward the reward system in science. There may also be modest positive effects of such new awards in the form of heightened popular esteem for science and interest in it. (shrink)

A hypnotic induction produces different patterns of spontaneous experiences across individuals. The magnitude and characteristics of these responses covary moderately with hypnotic suggestibility, but also differ within levels of hypnotic suggestibility. This study sought to identify discrete phenomenological profiles in response to a hypnotic induction and assess whether experiential variability among highly suggestible individuals matches the phenomenological profiles predicted by dissociative typological models of high hypnotic suggestibility. Phenomenological state scores indexed in reference to a resting epoch during hypnosis were submitted (...) to a latent profile analysis. The profiles in the derived four-class solution differed in multiple experiential dimensions and hypnotic suggestibility. Highly suggestible individuals were distributed across two classes that exhibited response patterns suggesting an inward attention subtype and a dissociative subtype. These results provide support for dissociative typological models of high hypnotic suggestibility and indicate that highly suggestible individuals do not display a uniform response to a hypnotic induction. Background Generally, there is unanimity about the value of community engagement in health-related research. There is also a growing tendency to view genetics and genomics research (GGR) as a special category of research, the conduct of which including community engagement (CE) as needing additional caution. One of the motivations of this study was to establish how differently if at all, we should think about CE in GGR. Aim To assess the perspectives of genetics and genomics researchers in Uganda on CE (...) in GGR. Method A cross-sectional qualitative study was conducted at Makerere University and Uganda Virus Research Institute. Twenty-five individuals participated, the majority being male (sixteen). Participants included nineteen genetics and genomics researchers (researchers and research coordinators), two CE officers, three nurses and one nursing counsellor. Data were collected using in-depth interviews and analyzed in a thematic manner using NVivo version 12 Plus. Study findings Thirteen of the respondents had conducted CE in their GGR in either a geographical and disease-specific community. Some respondents said CE principles are the same and there is no need for special consideration for CE in GGR. Others gave ethical issues in GGR that require special consideration for CE in such research and these were categorized into six themes: GGR is new to communities, Difficulty in communicating GGR by the researchers, Genes are shared in communities, Cultural sensitivities against GGR, Community attitude toward GGR, Some GGR studies take long to end, and Negotiation of research benefits. Special considerations for CE when conducting GGR were suggested and categorized into seven themes: creating awareness of GGR in communities, obtaining both community acceptance and individual consent, CE team composition, involve communities in solving GGR challenges, prolong CE in some GGR, develop guidelines for CE in GGR, and legal considerations on GGR. Conclusion GGR was characterized by special issues that require special CE considerations for such research. (shrink)

Raising the war on political correctness to a new and higher intellectual level, Philip Devine sheds fresh light on the whole question of cultural standards and the fashionable notion of multiculturalism. While acknowledging the diversity of ways of life and the differing belief systems that arise from and justify those ways of life, the author attacks the current exploitation of diversity to justify a militantly intolerant relativism. His wide-ranging and erudite work connects cultural issues to our real-world existence as (...) biological and historical beings, pulling together ideas of bioethics, education, and the structure and purpose of families. This work will be of interest to those fighting the culture wars across the humanities and social and behavioral sciences. (shrink)

This paper argues that proper functions are proximal functions. In other words, it rejects the notion that there are distal biological functions – strictly speaking, distal functions are not functions at all, but simply beneficial effects normally associated with a trait performing its function. Once we rule out distal functions, two further positions become available: dysfunctions are simply failures of proper function, and pathological conditions are dysfunctions. Although elegant and seemingly intuitive, this simple view has had surprisingly little uptake in (...) the literature. Indeed, our position departs from that of almost every theorist who has engaged with the issue at any depth. We start by presenting three arguments for the position that proper functions are proximal: one from the specificity of functions, one from their relation to intervention, and one from their relation to pathology. We then consider two case studies evidencing the trouble that accepting distal functions causes for philosophical reflection on the nature of pathological conditions. Finally, we anticipate and respond to three objections: that there can be failure of function without dysfunction; that our account is unacceptably revisionary in respect of normal function-talk; and that our thesis over-generalises from a narrow set of cases. To mark International Women’s Day the Research Group for Law, Gender and Sexuality at Westminster Law School held an evening conversation on 10 March 2016 on Women and Asylum. Speakers working in different areas of the asylum system shared their insights and experiences with an audience of staff, students, activists and other visitors. Harriet Samuels chaired the conversation and the speakers were Princess Chine Onyeukwu, Debora Singer, Priya Solanki and Zoe Harper. This article is an edited extract from the (...) transcript of the presentations and wide-ranging discussion, including the question and answer session. The discussion focused on the different steps in the refugee determination process and considered, in particular, the gendering of credibility and how women’s perceived lack of credibility has a significant impact on determinations and processes. In this article, I explore how researchers’ metaphysical commitments can be conducive—or unconducive—to progress in animal cognition research. The methodological dictum known as Morgan’s Canon exhorts comparative psychologists to countenance the least mentalistic fair interpretation of animal actions. This exhortation has frequently been misread as a blanket condemnation of mentalistic interpretations of animal behaviors that could be interpreted behavioristically. But Morgan meant to demand only that researchers refrain from accepting default interpretations of (apparent) actions until other fair interpretations have been (...) duly considered. The Canon backfired largely because of Morgan’s background metaphysical commitment to a univocal, hierarchical, and anthropocentric account of cognitive architecture. I make the case that, going forward, comparative psychologists would do well to pair judicious use of Morgan’s Canon with an openness to the existence of non-humanlike animal minds comprising phenomena belonging to distinct cognitive and folk psychological ontologies. And I argue that this case gives us pragmatic reason to reconcile deep—e.g., psychofunctionalist—and superficial—e.g., dispositionalist—approaches to the metaphysics of belief. (shrink)

I have proposed wedding the theories of belief known as dispositionalism and interpretivism. Krzysztof Poslajko objects that dispositionalism does just fine on its own and, moreover, is better off without interpretivism’s metaphysical baggage. I argue that Poslajko is wrong: in order to secure a principled criterion for individuating beliefs, dispositionalism must either collapse into psychofunctionalism (or some other non-superficial theory) or accept interpretivism’s hand in marriage.

Analogies between Newtonian mechanics and evolutionary processes are powerful but not infinitely versatile tools for generating explanations of particular biological phenomena. Their explanatory range is sensitive to a preliminary decision about which processes count as background conditions and which as special forces. Here I argue that the defenders of the zero-force evolutionary law are mistaken in defending their decision as the only appropriate one. The Hardy–Weinberg principle remains a viable option that is consistent with the epistemic role of Newton’s own (...) first law, and the strengths and weaknesses of each analogy are sufficiently distinct to justify their continued coexistence. In this first book-length examination of the Cartesian theory of visual perception, Celia Wolf-Devine explores the many philosophical implications of Descartes’ theory, concluding that he ultimately failed to provide a completely mechanistic theory of visual perception. Wolf-Devine traces the development of Descartes’ thought about visual perception against the backdrop of the transition from Aristotelianism to the new mechanistic science—the major scientific paradigm shift taking place in the seventeenth century. She considers the philosopher’s work in terms of its background (...) in Aristotelian and later scholastic thought rather than looking at it "backwards" through the later work of the British empiricists and Kant. Wolf-Devine begins with Descartes’ ideas about perception in the _Rules _and continues through the later scientific writings in which he develops his own mechanistic theory of light, color, and visual spatial perception. Throughout her discussion, she demonstrates both Descartes’ continuity with and break from the Aristotelian tradition. Wolf-Devine critically examines Cartesian theory by focusing on the problems that arise from his use of three different models to explain the behavior of light as well as on the ways in which modern science has not confirmed some of Descartes’ central hypotheses about vision. She shows that the changes Descartes made in the Aristotelian framework created a new set of problems in the philosophy of perception. While such successors to Descartes as Malebranche, Locke, Berkeley, and Hume accepted the core of his theory of vision, they struggled to clarify the ontological status of colors, to separate what is strictly speaking "given" to the sense of sight from what is the result of judgments by the mind, and to confront a "veil of perception" skepticism that would have been unthinkable within the Aristotelian framework. Wolf-Devine concludes that Descartes was not ultimately successful in providing a completely mechanistic theory of visual perception, and because of this, she suggests both that changes in the conceptual framework of Descartes are in order and that a partial return to some features of the Aristotelian tradition may be necessary. I was an altar girl at St. Mary the Virgin, New York City–one of the first, in fact. In the mid‑70s, one of my friends approached the Rector and negotiated a deal: we women, who were interested in acolyting, would be allowed to serve at mass during the week, in street clothes, on the condition that we form and staff an altar guild.

Until recently, torture was regarded as an unthinkable act. But in the dark years following September 11, 2001, many people have defended it openly as they have many other kinds of action previously considered taboo. And the underlying issues are complicated. Yet at least a virtually absolute prohibition on interrogational torture can be rationally defended.

I take the essence of relativism to be that reasoning is possible only given shared assumptions, and that there is a plurality of possible sets of assumptions between whose adherents no argument is possible. Crucial to relativism, thus conceived, is the existence of basic standards, which underlie the assertions human beings make. Philosophers who have taken relativism seriously have given the sources of such standards various names: I here settle on the word “frameworks.”.

Women whether at home or at work, are generally more easily hurt by difficult situations and angry words, and are less able to cope with the cut and thrust of life. We were made as complementaly individuals to men and we need their strength, their objectivity and their protection at difficult times. But equally, ourvery sensitiiity and vulnerability makes us more ready to recwnize our need of God and of His daily power and While a man is often too busy (...) to acknowledge his need of a Saviour, a woman knows her need because it is an integral part of her own make-up1.
